Nobody has automatic authority to make decisions about your financial and welfare arrangements if you lose the ability to make decisions for yourself, and as incapacity or the inability to attend directly to your affairs can come either with old age or indeed suddenly at any time, a Power of Attorney is invaluable and can take the strain and frustration away from close family and friends as this will enable your Attorney to act for you.

To ensure it can be used to its maximum potential, the typical format that we recommend is a combined ‘Continuing and Welfare Power of Attorney’ which covers both financial and welfare matters and is registered with the Office of the Public Guardian in Scotland.
